Terms of Service

1. Scope

These Terms of Service govern all contracts for the provision of the digital software product “Frozen Tweaks” between Pelle Krukow, Volksdorfer Str. 5, 22081 Hamburg, Germany (the “Provider”), and customers using this website and customer area.

Consumer means any natural person acting for purposes that are outside their trade, business, or profession (Sec. 13 BGB). Entrepreneur means any natural or legal person or partnership with legal personality who, when entering into the contract, acts in exercise of their trade, business, or profession (Sec. 14 BGB).

2. Subject Matter

The Provider makes available the “Frozen Tweaks” software to optimize PC settings for gaming performance. The software is supplied as digital content not on a tangible medium.

A free version and a paid lifetime license may be offered. Feature scope is described on the website at the time of purchase.

3. Conclusion of Contract

Product displays in the store are non-binding catalogs. By clicking “Buy” or “Get Lifetime Access” you place a binding order. The contract is concluded when the Provider confirms by email or makes the download or activation available.

4. Prices and Payment

All prices are final prices. As a small business pursuant to Sec. 19 UStG, no VAT is charged or shown on invoices.

Payment is made via the methods shown at checkout. Delivery of the digital content occurs after successful payment.

5. Account, License, Acceptable Use

With a lifetime license, you receive a simple, non-exclusive, non-transferable, non-sublicensable, time-unlimited right to use the software for personal, non-commercial purposes on your own devices, subject to these Terms.

• No resale, transfer, lending, or rental of the license or access.
• No decompiling, reverse engineering, or modification unless permitted by law.
• No usage that circumvents technical protection or violates third-party terms or law.
• Account credentials must be kept confidential. You are responsible for all activity under your account.

6. System Requirements

You must review the published system requirements before purchase. The Provider does not warrant operation on every system configuration.

7. Right of Withdrawal for Consumers

Consumers generally have a statutory 14-day withdrawal right. For digital content not on a tangible medium, this right expires early once the Provider begins performance after you have expressly consented to the start of performance before expiry of the withdrawal period and acknowledged that you lose your withdrawal right upon start of performance (Sec. 356(5) BGB).

8. Refund Policy

After download, activation, or first use following your above consent, statutory withdrawal no longer applies and refunds are generally excluded. A goodwill refund may be considered for proven technical incompatibility where requirements are met, you cooperated with support, and the issue cannot be resolved within reasonable time. 9. Updates, Availability, Changes

The Provider may release updates or changes at its discretion. There is no claim to uninterrupted availability. Planned maintenance or security-related downtime may occur.

If features are materially changed for paid customers, the Provider will act reasonably and in line with statutory rights. Statutory warranty rights remain unaffected.

10. Warranty

Statutory warranty rights apply. At delivery the software is free from material and legal defects.

The Provider does not guarantee uninterrupted or error-free operation. Support and updates are provided at the Provider’s reasonable discretion.

11. Liability

The Provider is liable without limitation for intent and gross negligence and for injury to life, body, or health. For simple negligence, liability exists only for breach of an essential contractual duty, limited to the foreseeable damage typical for the contract. Mandatory product liability remains unaffected.

The Provider is not liable for damage caused by improper use or by incompatibilities with third-party software or services outside the Provider’s control.

12. Intellectual Property

All rights in and to the software, the website, and related materials remain with the Provider or its licensors. Third-party trademarks and brand names belong to their respective owners.

13. Data Protection

Personal data is processed in accordance with the GDPR and German law. Details are set out in our Privacy Policy.

14. Export Control and Sanctions

You represent that you are not subject to EU, UK, or US sanctions prohibiting receipt of the software and that you will not use the software in violation of applicable export control laws.

15. Governing Law and Venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory protective provisions of the state of habitual residence remain applicable.

If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Hamburg, Germany. Statutory places of jurisdiction for consumers remain unaffected.

16. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/.

The Provider is neither willing nor obliged to participate in dispute resolution before a consumer arbitration board.

17. Changes to these Terms

The Provider may amend these Terms with effect for the future where necessary for legal, technical, or business reasons and where the change does not unreasonably disadvantage customers. Material changes for ongoing paid relationships will be communicated in advance. Continued use after the effective date constitutes acceptance.

18. Severability and Language

If any provision is or becomes invalid, the remaining provisions remain in force. An effective provision that comes closest to the economic intent shall replace the invalid provision.

This English version governs unless a mandatory local-language requirement applies.
